JACKSON, Miss. (WLBT) - The man described by prosecutors as the ringleader of the Rankin County Goon Squad claims a federal judge sentenced him to an excessive amount of prison time for his role in the rape and torture of two Black men, according to court records filed Wednesday.
The attorney for former Rankin County Chief Investigator Brett McAlpin argues that his client was not a member of the squad nor its leader when four other Rankin County deputies and a Richland Police officer responded to a Braxton home in January 2023.
The encounter, which involved sexual assault, torture and prolonged bouts of tasing, reached a horrifying climax when former deputy Hunter Elward put his gun inside the mouth of Michael Corey Jenkins and fired, seriously injuring him.
McAlpin’s appeal concedes he did set everything in motion, however, when he reached out to two different deputies to get them to check out a house for suspicious activity.
The 73-page filing, written by attorney Theodore Cooperstein, states McAlpin didn’t order anyone to do anything inside the home nor participated, but he was there when most of the violent events took place.
The filing also admits McAlpin played a pivotal role in the coverup that followed that night of torture.
McAlpin and the five former officers all signed plea agreements with the U.S. Government last year, which waived their right to an appeal.
Cooperstein maintains his client is no longer bound by that restriction because the government did not live up to its end of the plea agreement, rendering it null and void.
The attorney said the feds didn’t dismiss any counts against McAlpin, and because it didn’t offer him any benefit for cooperating, the government breached the agreement.
Cooperstein said his client also got the second-highest sentence of the six men -- 327 months -- even though his role was not as prominent as anybody else’s.
Investigators concluded former deputy Jeffrey Middleton was actually in charge of the Goon Squad itself, yet only got 200 months behind bars. Elward nearly killed Jenkins when he shot him in the mouth, yet got roughly two-thirds of McAlpin’s sentence.
McAlpin’s lawyer also claims the government lumped in other cases where McAlpin was accused but never convicted of similar torture incidents and enhanced his penalties based on those unproven claims.

RIDGELAND, Miss. (WLBT) - Another municipality is joining the long list of cities and counties that have banned the use and sale of Kratom.
On Tuesday, the Ridgeland mayor and Board of Aldermen approved a measure banning the drug in the city limits.
Because the measure was passed unanimously, it goes into effect immediately, Mayor Gene McGee said.
“It can be something that can be dangerous, particularly for young people not knowing what they’re getting into. We really needed to get it off the shelves,” he said.
McGee said in about 10 days, the Ridgeland Police Department will begin working with businesses to pull the substance.
“A week or two after they ask them to do that, then if someone continues to have it on their shelves, selling it, that sort of thing, they’ll be written tickets,” he said.
Meanwhile, officials in the city of Madison say they’re likely going to take action to ban Kratom as well.
“I anticipate the city of Madison will put an ordinance before the board very soon,” said City Attorney Chelsea Brannon. “We were waiting to see what the Legislature did to make sure we didn’t do anything contrary [to state statute].”
Kratom comes from a tropical tree in Southeast Asia. Based on the dosage, the consumption of Kratom leaves can serve as a stimulant or a sedative. The substance largely is sold at convenience stores, vape, and CBD shops, according to Drug Enforcement Agency data.
At least a dozen counties and more than two dozen cities have banned the substance across the state, including Gluckstadt back in 2022.
Since implementing the ordinance, Gluckstadt Police Chief Barry Hale said the city has had few violations.
“We did have one store that we found was [selling] it. We went and talked with them and worked with them, and they took it out, but as far as having to cite anybody or anything like that, we have not,” he said.
Despite being banned on the local level, Kratom is not banned in the state.
Months following a WLBT investigation, at least eight pieces of legislation were introduced during the 2024 legislation session to address the drug, but none of them passed.

Check of Suspicious Vehicle leads to the Arrest of Copper Thief
On Wednesday, August 21, 2024, at 5:17 am, a deputy assigned to the Rankin County Sheriff’s Department Patrol Division observed a black 2011 Nissan Rogue on Hwy 471 near Hwy 25 that appeared to be disabled.
After stopping to check on the driver and any occupants of the vehicle, the deputy noted that although the SUV was unoccupied there were no other suspicious circumstances regarding it. After logging the vehicle information with the sheriff’s office dispatch center, he continued with his routine patrol of the area. A short time later the deputy went back to check on the vehicle
again and observed a male walking out from behind a locked gate to a commercial area.
The male entered the black SUV and began proceeding northbound on Hwy 471 when the deputy initiated a traffic stop on the vehicle.
During the on-scene investigation by the deputy he was able to identify the driver of the vehicle as Montana Jack Davis and learned that he had trespassed into the commercial area. While interviewing Davis, the deputy noted that there were now multiple items clearly visible inside the SUV including copper wires and tools consistent with burglary and copper theft.
Subsequent investigation by the deputy and investigators with the sheriff’s office revealed that Davis had stolen several items of copper wire from the area after burglarizing a semi-truck trailer parked on the property. Once the property owner had been contacted it was discovered that Davis had also stolen a digital security camera and corresponding digital recording device used to monitor the area.
Further interviews with Davis and the execution of the search warrants led sheriff’s office investigators to evidence which shows Davis perpetrated two (2) additional copper thefts within city of Brandon and one (1) copper theft within city of Flowood.
Montana Jack Davis was arrested and has been charged with multiple counts of Theft and Burglary in addition to Possession of Burglary Tools.
Rankin County as a whole has experienced an increase in the theft of copper and would like to encourage residents who observe any suspicious activity to notify your local police department or the Rankin County Sheriff’s
